Personal Use:

Summary

Defined as photography commissioned or purchased for personal use. The image can be printed on any medium for personal purposes or as gifts. The image cannot be shared on the Internet through any medium.

Agreement

Jerald Boyd and ViZionZ@BoydNet (hereafter referred to as “licensor”) grants the client (hereafter referred to as “licensee”) the non-exclusive, non-transferable, and non-assignable use of the image bought under this license for an unlimited period of time for personal use.

Examples of permitted uses

Prints (any format) for personal use or gifts
Images may be backed up or archived as necessary to complete the about stated uses only.

Examples of prohibited uses

Images may not be placed in a downloadable format on the Internet, electronic bulletin board, or shared via P2P (peer to peer) file sharing networks or utilities.
Images may not be altered from its original state (with the exception of cropping) for permitted usage under this agreement.
Images may not be used to create pornographic, libelous, obscene, fraudulent, illegal, or defamatory material.

Provisions

Licensor retains all copyright and moral rights attached to the image as well as any other rights not detailed in this agreement.

No title, copyright, or intellectual property rights in the photos are transferred with this license. Selling and/or redistribution of this image is prohibited. Online publication of the image or an edited version is prohibited.

Indemnity

Licensee agrees to indemnify and hold licensor harmless against any and all claims or liabilities asserted against Jerald Boyd and ViZionZ@BoydNet, arising out of access to these photos or in any connection with the breach of any of the terms of this agreement.

Warranty and liability

This image is provided “as-is” with no warranty regarding the suitability of the image for any purpose. The licensor is not liable to the licensee or any person or entity for damages, costs, or losses stemming from any usage of this image.

Non-Commercial Rights (Editorial Rights)

Summary

Defined as photography used for educational or journalistic purposes.

Agreement

Credit/Acknowledgement of the licensee’s name and website URL (vizionz.boydnetonline.com) must be given when the image is published, either with a picture credit, caption, or a link/acknowledgement in the publication if the image is used for editorial purposes (newspapers, magazines, newsletters, web or print publications, etc…).
